No, the Supreme Court did not “change the game” in trademark law. In recent days, headlines have been circulating suggesting a major shift in trademark law in Mexico. The reality is much simpler. What actually happened? On one hand, the Supreme Court reiterated that a trademark registration may be invalidated if it was granted in violation of the law. This is nothing new, it has long been a recognized ground under the Federal Law for the Protection of Industrial Property. On the other hand, a judicial opinion published in the Federal Judicial Weekly revisits existing criteria regarding trademark use in cancellation (non-use) cases. The rules of the game have not changed. Courts are simply confirming principles that were already part of the legal framework. At Tsuru, we guide you through it.
